5. Statutory (Automatic Approval) Agenda - This agenda consists of items previously approved by Council action such as adoption of items that are part of an approved budget or capital improvement projects, first and only readings of ordinances, interlocal agreements, or action that is required by law or delegated to the City Manager. Items may be removed from the statutory agenda for separate consideration at the request of two Councilmembers.

A. Approve purchasing three (3) infield groomers from Professional Turf Products, L.P., in an amount not to exceed $73,860.01.

B. Contract for the 2018 RELLIS Campus Area Annexation Feasibility and Strategy Study and related services with Kendig Keast Collaborative in an amount not to exceed $115,425.

B. under the authority of Section 551.071, consultation with attorney - receive legal advice regarding Suddenlink and Frontier's refusal to move out of right-of-way, receive legal advice regarding In the Matter of the Complaint of the Brazos Valley Groundwater Rights Association and Tony Fazzino against the City of Bryan Well No. 18 (BVDO-003), receive legal advice regarding groundwater issues, receive legal advice regarding enforcement issue regarding an illegal dump on 186.9 acres off Highway 6 frontage BCAD R#39004 and receive legal advice regarding the case of Rick R. Sims v. Sharon Gamble, Marni Holloway, Alsie Bond, and the City of Bryan, Texas, Southern District of Texas, Cause No. 4:17-2359 and legal issues regarding the City’s responsibilities and options related to tax credit project proposals under the Texas Department of Housing and Community Affairs (“TDHCA”) Competitive Tax Credit Program; and

C. under the authority of Section 551.074, personnel - discussion regarding duties and responsibilities of City Manager and deliberate the appointment, employment, evaluation, and duties of a public officer or employee: (1) annual performance evaluation of the Internal Auditor.
